This case involves a challenge to the Wisconsin Full Crew Law. The plaintiffs-respondents are eight railroads which operate in Wisconsin and in other states. They commenced an action for a declaratory judgment that secs. 192.25 (2), (4) and (4a), and 192.55 (4), Stats., are unconstitutional insofar as they require firemen to be a part of main crews in over-the-road freight trains and in yard service. No challenge is lodged against the full-crew laws in respect to passenger-train operations. The defendants-appellants demurred to the complaint. The complaint alleges three causes of action: (1) Substantive due process; (2) unconstitutional burden upon interstate commerce; (3) equal protection of the laws. The trial court overruled the demurrers. It rested its decision on the second cause of action. It held that a judicial investigation should be undertaken. The court ordered the appellants to advise the respondents and the court, by way of answer, what they consider the reasonable basis or justification for the challenged statutes.
